Please read these Terms of Service ("Terms") carefully before using the EvoraWise mobile application, website, and related services. By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, accessing, or using the EvoraWise application ("App"), website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree with any part of these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and EvoraWise ("we," "us," or "our").

2. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the Service. If you are under 18, you represent that you have your parent's or legal guardian's consent to use the Service. By using EvoraWise, you represent and warrant that you meet these eligibility requirements.

3. Account Registration & Security

To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Keep your password confidential and not share it with anyone
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

Your account is managed through Appwrite, our authentication and user management platform. You may delete your account at any time through the App settings or our Delete Account page.

4. Description of Services

EvoraWise provides an event management platform that enables users to:

  • Create, manage, and promote events
  • Browse and discover events
  • RSVP and register for events
  • Manage attendee lists and event logistics
  • Communicate with event organizers and attendees
  • Access event analytics and reports

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

5. User Conduct

You agree not to use the Service to:

  • Violate any applicable law, regulation, or third-party rights
  • Post false, misleading, defamatory, or fraudulent content
  • Harass, bully, threaten, or intimidate other users
  • Upload malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Scrape, crawl, or use automated means to access the Service without permission
  • Create events that promote illegal activities, violence, or discrimination
  • Impersonate another person or entity

We reserve the right to suspend or terminate accounts that violate these guidelines without prior notice.

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal data. By using the Service, you consent to the data practices described in our Privacy Policy.

Key points: We use Appwrite for authentication and user data management, and Convex (convex.dev) for real-time application data storage. Your data is encrypted, securely stored, and never sold to third parties. You have the right to access, correct, and delete your data at any time.

7. Third-Party Services

The Service integrates with and relies on the following third-party service providers:

Appwrite

Backend-as-a-Service for user authentication, account management, and session handling. Your account credentials and profile data are processed by Appwrite. See Appwrite's Terms and Privacy Policy.

Convex (convex.dev)

Real-time database and backend platform for storing events, bookings, attendee data, and application content. See Convex's Terms and Privacy Policy.

By using our Service, you also agree to comply with the terms and policies of these third-party providers. We are not responsible for the practices or content of third-party services, and your use of them is at your own risk.

8. Payments & Billing

Certain features of the Service may require payment. If you purchase a paid plan or service:

  • A booking is confirmed upon receipt of the required deposit (typically 30% of total fees)
  • All prices are displayed in USD unless otherwise indicated
  • Payments are processed securely through third-party payment processors
  • We do not store full credit card numbers on our servers
  • Late payments may incur additional fees as outlined in your service agreement
  • You are responsible for all applicable taxes

9. Cancellation & Refund Policy

For paid event management services:

  • More than 60 days before event: Full refund minus a 10% administrative fee
  • 30–60 days before event: 50% refund of total fees paid
  • Less than 30 days before event: No refund; fees are non-refundable

Third-party vendor cancellation fees may apply separately and are the client's responsibility. For purchases made through the Google Play Store, refund policies may also be subject to Google Play's refund policies.

10. Intellectual Property

All content, features, and functionality of the Service — including text, graphics, logos, icons, images, software, and code — are the property of EvoraWise or its licensors and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.

Content you create and upload to the Service (e.g., event descriptions, images) remains your property. By uploading content, you grant EvoraWise a non-exclusive, royalty-free license to use, display, and distribute that content solely in connection with operating the Service.

11. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

To the maximum extent permitted by applicable law, EvoraWise and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising from your use of or inability to use the Service. Our total aggregate liability for any claim shall not exceed the amount you paid to EvoraWise in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless EvoraWise, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) any content you upload or create through the Service.

14. Termination

You may terminate your account at any time by using the delete account feature in the App or on our Delete Account page. We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms.

Upon termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy (within 30 days), except where retention is required by law.

15. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be resolved in the state or federal courts located in Travis County, Texas.

16. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and notify you through in-app notifications or email where appropriate. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service.
